On Sunday, October 13, 1985 I stayed at my residence at
92 Draper Street in Dorchester, all day. I was at that time
booked on a flight to Portland, Oregon, on Western Airlines
at 7:40 a.m., Tuesday, October 15, 1985, and I was writing at
my residence an affidavit I needed to finish before I left.
I worked in my office at the firm of Flynn & Joyce on October 14,
1985, Columbus Day.
My residence is a three-family dwelling. I live on the
top floor with four other men: Ryan Thayer, the landlord,
Richard Pattison, Mark Michaels and Edward Maglott. Two
women, Suzanne Shepherd and Sue Bell live on the second floor.
At approximately 12:30 p.m. Suzanne came to the third floor door, knocked and I answered. She said she had two extra tickets for a play entitled "Cloud Nine" for that afternoon at 3:00 p.m., and she invited me and someone else. I declined, informing her that I had a lot of work to get done before I left on Tuesday. However, I talked at that time to Ryan and Edward. Ryan agreed to go, and Edward declined.
Suzanne talked to us for approximately 15 minutes. She then returned to her apartment on the second floor. Ryan and I then talked to Mark who agreed to go with Ryan. All of this took up to approximately 1:15 p.m. I went back to writing in my room.
At approximately 2:00 p.m. Suzanne arrived and said that she was just about to leave. I looked for Ryan but he was not in his room. Suzanne returned to her apartment, and I wrote a note to Ryan in case he came back.
He arrived back at about 2:20 and we talked briefly at that time. Shortly thereafter he and Mark left to the play. I stayed in the apartment the rest of the afternoon. I did see Edward off and on throughout the rest of the afternoon. And I saw and spoke to Ryan and Mark when they returned from the play.
