publishes Torso International, and president of Jock
Magazine.

Embinder lives with Royce Lauren Walker, Director of Production for
Torso Magazine. The property they live at is owned by Edward B. Henne,
deceased.

In March 1977 All American Distributors Corporation sued Blue Boy,
Inc.; Blueboy, Inc., a Florida Corporation; Publishers Distributing
Corporation; Donald N. Embinder; and Morris B. Heifner, Jr. for Breach
of Contract, Accounting and for Injuntive Relief.

In August 1974 All American signed an exclusive contract to distribute
Blue Boy Magazine. In March 1976 All American learned that Heifner
allowed Publishers Distributing Corporation to distribute the mag. All
American is asked for $100,000 general damages, and a TRO to keep them
from distributing the mag. The case was dismissed with prejudice Jan
10, 1980.

Raymond W. Hartman, Century City, was the attorney for Embinder.
Robert D. Wilner, Van Nuys, was All American's attorney. Superior
Court case #C193964.

At that time, Blueboy was a Delaware Corporation.

Blue Boy, Inc.'s address was P.O. Box 33143, Washington, D.C. 20028.
All American's address was 8431 Melrose Place, LA 90069.

In February 1980, Charles (Chuck) A. Spence sued Blueboy of California,
Inc., Blueboy of Canada, Blueboy of Florida, Inc., California Knight
Life, Inc., John Drummer aka Zak Drummer dba Zachariah Graphics, Donald
N. Embinder, Flynt Distributing Co., and Soho Studios for a Temporary
Restraining Order, Preliminary Injunction, Permanent Injunction, and
Damages for Invasion of Privacy. This is Superior Court case #C313949.

Chuck had been employed as an accountant with Getty Oil Co., Inc. for
the previous two-and-a-half years. He claimed that without his consent,
pictures of him were distributed in gay mags, and this could ruin his
career with Getty.

Chuck says that he answered an ad placed by Zak Drummer who was looking
for a roommate. Chuck and Zak became roommates, and during the time
Chuck was with Zak, he consented to letting Zak take some pictures of
him, but no authorization was given for the pictures to go in
magazines. Attached to the court case is an inch thick of photocopies
of pictures of Chuck that were distributed. These are professional,

outdoors shots of Chuck posing or having sex with another man/men.

Chuck asked for $250,000 in general damages, and $1,000,000 punitive.
It was dismissed March 22, 1984.

Defendants were mentioned later in the file as being Donald Embinder,
Zak Drummer, Fred Smith, and Larry Flynt.

Blueboy, Inc. of Florida (Miami) is a corporation conducting business
in California as publisher and distributor of the magazines "Blueboy",
"Night Life", "California Knight Life" and "Getting Off at the Rocks"
(a single magazaine/booklet). Embinder is owner. Drummer is an
employee with Blueboy.

Zak's address was 1025 North Kings Road, #112, LA. He publishes Gaze
Magazine.

Embinder has three DBA's listed in 1985:

1) DNE filed Dec 30, 1985. Embinder is the sole registrant, and
lists his address as 1601 Marlay Drive.
2) D & B Productions filed July 11, 1985. The address for this
business is 8033 Sunset Blvd, Suite 637, Los Angeles 90046. Don
lists his address as 964 Hancock.  One other registrant is Bobb
Goldstein, address 1709 N. Fuller #14, Los Angeles 90046.
3) Musex Video Productions and X.T.V. Video Productions c/o D & B
Productions, 8033 Sunset. Registrants are Don and Bobb.
